Criminal Law Sector. In criminal proceedings, individuals with income below the threshold established for free legal aid are eligible for such aid, whether they are the accused/suspect or the injured party. For specific offenses—such as domestic abuse or abuse by a cohabiting partner (Art. 572 of the Penal Code), female genital mutilation (Art. 583-bis), sexual violence (Art. 609-bis), sexual acts with a minor (Art. 609-quater), and stalking (Art. 612-bis)—victims may ALWAYS access free legal aid, regardless of their income. Furthermore, victims of the following crimes may always access free legal aid if they are minors:
of reduction to slavery (Art. 600);
• child prostitution (Art. 600-bis);
• di pornografia minorile (art. 600-ter);
• it concerns persons and the purchase of slaves (Arts. 601 and 602);
• it concerns persons and the purchase of slaves (Arts. 601 and 602);

We also offer free legal aid before the European Court of Human Rights and before the European Court and European Court of Justice in all types of trials (civil, criminal, administrative, tax, voluntary jurisdiction).

The firm offers further opportunities for free legal representation—in both civil and criminal matters—to women who are victims of violence or stalking. Attorney Francesco Daniele is part of the network established by the Lombardy Region to address crimes and acts of violence against women. The Lombardy Region grants free legal representation—specifically in CRIMINAL MATTERS—through expert lawyers in the following cases:
Articles 56 and 575 of the Penal Code: attempted murder;
Article 584 of the Penal Code: preterintentional homicide;
Article 570 of the Penal Code: violation of family support obligations;
Article 581 of the Penal Code (battery);
Article 582 of the Penal Code: intentional bodily harm;
Article 586 of the Penal Code: death or injury resulting from another crime;

Art. 3 of Law 75/28: Aiding and abetting and exploitation of prostitution.

In civil proceedings, women who are parties to cases involving allegations of gender-based violence and/or domestic violence are eligible for free legal aid. To qualify, a formal complaint or criminal charge must be filed regarding the gender-based or related offenses.

Furthermore, this fund may be accessed by those applying for a civil protection order pursuant to Articles 342-bis and 342-ter of the Code of Civil Procedure.

Victims must have a personal income from employment not exceeding three times the threshold established by state regulations regarding state-funded legal aid for offenses other than those subject to the exception set forth in Article 76, paragraph 4-ter, of Presidential Decree no. 115 of May 30, 2002. For the purpose of accessing the fund's benefits, only the individual income of the female victim of violence is taken into account.
